The number of asbestos claims filed annually, the number and types of firms named as defendants in asbestos litigation, and the expenditure of the litigation to those defendants have all risen sharply in recent years. From the supplier: The expense of asbestos removal and replacement has been deemed a capital expense by the IRS thus eliminating current deductions because of the long-term gain from the enhancement. This runs counter to previous assumptions on deductibility and is based on the recent choice in the INDOPCO case. Letter Ruling 9240004 disputes case law which differentiated between repairs and capital improvements on the grounds of cost relative to material goods value, whether the life of the material goods was prolonged, whether the value of the material goods was augmented and the nature of the remedy.
